Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website zoo.my and all related services, including domain purchases, offers, enquiries, valuations and certificates (collectively, the "Services"), operated by the owner of zoo.my ("zoo.my", "we", "us", "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Nature of the Services

zoo.my is a marketplace for the sale, lease and valuation of internet domain names, principally domains under the Malaysian country-code extension .my and its sub-extensions (such as .com.my). Domains listed on zoo.my are offered by zoo.my as owner, or in future by third-party sellers. A listing is an invitation to treat, not a binding offer. No contract of sale exists until we expressly confirm acceptance of your purchase or offer in writing (including by email).

2. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract to use the Services. If you use the Services on behalf of a company or organisation, you represent that you are authorised to bind that entity, and "you" includes that entity. Certain .my extensions carry registrant eligibility requirements set by MYNIC (for example, .com.my requires a Malaysian-registered business). You are responsible for confirming that you or your entity meet the registry's eligibility requirements before purchasing.

3. Offers and purchases

• An offer you submit and confirm through the Services is a genuine expression of intent to purchase at the offered price. Repeatedly submitting offers with no intention to complete is prohibited and may result in a ban.
• Acceptance of an offer by us creates a binding agreement to purchase, subject to these Terms. A payment link will be issued; if payment is not received within the stated validity period, we may cancel the agreement and relist the domain.
• All prices are quoted in Malaysian Ringgit (RM) and, unless expressly stated otherwise, are exclusive of any applicable taxes, registry fees or registrar fees.
• Obvious pricing errors (for example, a price displayed at a small fraction of intended value due to a technical fault) do not bind us; we may cancel and refund any payment made against an erroneous price in full.

4. Payment and funds handling

• Payments are processed by Billplz, a licensed Malaysian payment provider, via FPX online banking or other methods offered at checkout. We do not receive or store your banking credentials or full card details.
• For domain purchases, funds are held and are not treated as final settlement of the sale until the registry transfer described in Section 5 is confirmed complete.
• If a transfer fails for reasons not attributable to you, you will receive a full refund of the purchase price.
• If a transfer fails because of your act or omission (including failure to provide documents required by the registry within a reasonable time after repeated requests), we may cancel the transaction; refunds in that case are at our reasonable discretion, less costs actually incurred.

5. Domain transfers and MYNIC

• Ownership transfer of .my domains is processed by MYNIC Berhad, the administrator of the .my registry. The process typically completes in 14 to 21 working days and may involve deletion and reissuance of the domain to the new registrant.
• Transfer timelines are set by MYNIC, not by us. We do not and cannot guarantee any specific completion date. Delays caused by the registry, the registrar or your own responsiveness do not constitute breach by us.
• .com.my and certain other sub-extensions require supporting documents from the buyer (for example, SSM business registration documents). You must supply these promptly on request.
• Until the registry confirms the transfer, the domain remains under our (or the seller's) control. We will not release a domain before payment is secured, and payment is not finally released to a seller before the registry confirms the transfer.

6. Leasing and lease-to-own

Where a lease or lease-to-own arrangement is offered, nameserver control is provided through the registry's technical contact mechanism for the duration of the term; registrant ownership does not transfer until all scheduled payments have been completed under the applicable lease agreement. Failure to pay a scheduled instalment may result in suspension of the domain's services and, after the cure period stated in the lease agreement, termination of the arrangement without transfer of ownership. Specific lease terms are set out in the individual lease agreement, which prevails over these Terms to the extent of any inconsistency.

7. Estimated Market Value and certificates

• The "Estimated Market Value" tool and any paid certificate express an automated, formula-based estimate produced from publicly observable domain characteristics and our own market data. It is an opinion generated by software, not a professional valuation, appraisal, audit or financial advice, and it is not prepared by a licensed valuer.
• Estimates are not a promise that any domain can be sold at, or near, the estimated figure. Actual market prices depend on willing buyers and can differ materially, in either direction.
• You must not rely on an estimate or certificate for accounting, taxation, security for lending, insolvency, legal proceedings or any regulatory purpose. If you require a valuation for such purposes, engage a qualified professional.
• We accept no liability for any decision made, or loss suffered, in reliance on an estimate or certificate, to the maximum extent permitted by law.
• Certificate fees are for the generation of the document and are non-refundable once the certificate has been issued.

8. Trademarks and third-party rights

• Domains are sold as alphanumeric strings on an "as is" basis. We make no representation that your intended use of any domain will not infringe trademarks, trade names, personality rights or other rights of third parties in Malaysia or elsewhere.
• You are solely responsible for conducting trademark clearance (including searches of the MyIPO register) before purchasing and before using a domain.
• All domain purchases are subject to the registry's dispute policies, including the MYNIC Domain Name Dispute Resolution Policy (MYDRP). If a domain is transferred away from you under a dispute decision after sale, that is a risk you accept on purchase; we are not liable for the outcome of any such proceeding commenced after completion.

9. Acceptable use

You agree not to:

• submit false, misleading or fraudulent enquiries, offers or account information;
• use the Services to harvest data, scrape listings at scale, or probe, disable or overload our infrastructure;
• circumvent rate limits, submission limits or security controls (including the limits applied to the free valuation tool);
• use the Services in connection with money laundering, terrorism financing or any unlawful purpose; or
• infringe our intellectual property, including copying substantial parts of our listing copy, valuations or site content for a competing service.

We may suspend or terminate access, cancel transactions not yet completed, and refuse future service to any person who breaches this section.

10. Intellectual property

All content on zoo.my, including text, descriptions, logos, design, code and the valuation methodology, is owned by or licensed to us and protected by Malaysian and international intellectual property laws. Domain listings and descriptions may be viewed for personal purchase research only. No licence is granted to reproduce or exploit our content except as necessary to use the Services as intended.

11. Disclaimers

The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure, that listing information (including traffic, age or history of a domain) is complete or accurate, or that any domain will retain or gain value.

12. Limitation of liability

To the maximum extent permitted by law: (a) we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, data or business opportunity, arising out of or in connection with the Services; and (b) our total aggregate liability for all claims arising out of or in connection with any transaction is limited to the amount you actually paid to us for that transaction, and for all other claims to RM100. Nothing in these Terms excludes liability that cannot be excluded under Malaysian law, including liability for fraud.

13. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, damages, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, your use of any domain purchased or leased through the Services, or your infringement of any third-party right.

14. Personal data

Our collection and processing of personal data is governed by our Privacy Policy, which forms part of these Terms and complies with the Personal Data Protection Act 2010.

15. Changes to the Services and these Terms

We may modify the Services, listings and prices at any time, and may amend these Terms by posting an updated version on this page with a revised "Last updated" date. Amendments do not apply retroactively to transactions already confirmed. Your continued use of the Services after an amendment constitutes acceptance of the amended Terms.

16. General

• Governing law. These Terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over any dispute, subject to Section 17.
• Severability. If any provision is held invalid, the remainder continues in force.
• No waiver. A failure to enforce a provision is not a waiver of it.
• Assignment. You may not assign your rights under these Terms without our written consent. We may assign our rights in connection with a sale of the business.
• Entire agreement. These Terms, the Privacy Policy and any transaction confirmation together form the entire agreement between you and us regarding the Services.

17. Dispute resolution

Before commencing legal proceedings, you agree to first contact us and give us 30 days to resolve the dispute in good faith. Disputes concerning domain name rights (as opposed to the purchase contract) may also be subject to the MYNIC Domain Name Dispute Resolution Policy.
